1. Presentation and definitions
This site is owned, maintained, and operated by EVYA TECNOLOGIA LTDA, with address at Rua Duque de Caxias, 223, Centro, Gaspar - SC, CEP.: 89.110-052, registered with the CNPJ/MF under n. 36.788.134/0001-66, with State Registration No. 260459020 and email address contato@evya.tech. This document lists the terms and conditions that must be observed by Evya and its Users (as defined below) when using the Site, its tools and its functionalities. Evya provides access and use of the Site to any Users. The User declares to have read and accepted these Terms and Conditions of Use and Policies before starting to use the Site. If the User does not accept these Terms and Conditions of Use, he will not be allowed access to restricted areas of the Site. For the purposes of these Terms and Conditions of Use, as well as the Policies, the terms below shall have the following meanings: CALM. Evya Call Center is the customer service provided by EVYA TECNOLOGIA LTDA through various communication channels, indicated in each of the Policies and in item 18 of these Terms and Conditions of Use;
Customers: Users who filled out the registration form and hold an Access Account;
Purchase: Transaction whereby a Customer acquires a product offered for sale on the Site, upon payment of the value of the product;
Access Account: Credential defined by the user name (login) and password of a registered visitor (Customer), personal and non-transferable, which allows access to the restricted area and exclusive functionalities on the Site, such as accessing and changing personal data, registration and canceling participation in courses, creating, editing and removing wish lists, among others;
Brand: Any distinctive signs owned by and/or licensed to EVYA TECNOLOGIA LTDA, which are used to identify the Site, its content or the service provided by EVYA TECNOLOGIA LTDA.
Policies: The policies that complement and integrate these Terms and Conditions of Use, namely the Exchanges and Returns Policy, Payments Policy, Product Delivery Policy and the Privacy and Security Policy, all available on the Site;
Intellectual property of EVYA TECNOLOGIA LTDA. All intellectual property assets owned by EVYA TECNOLOGIA LTDA, any company belonging to its economic group, or even a third party, whose use is licensed and/or authorized by EVYA TECNOLOGIA LTDA, including but not limited to Trademarks, patents, inventions or utility models, industrial designs, know-how, business secrets, illustrations, photographs and/or content of any screen on the Site or any intellectual works or other content that are inserted in any intellectual work or any property protected by intellectual property rights.

Users: Any person accessing the Site, including anonymous visitors and Customers.
2. Rules for using the Site
The User undertakes to use the Site respecting and observing these Terms and Conditions of Use, as well as current legislation, customs and public order. Thus, the User agrees that he may not: (i) harm the rights of third parties, regardless of their nature, at any time, including during the use of the Site; (ii) perform acts that limit or prevent access and use of the Site, under appropriate conditions, to other Users; (iii) unlawfully access the Site or computer systems of third parties related to the Site or to EVYA TECNOLOGIA LTDA in any way or form; (iv) disseminate computer programs or viruses capable of causing damage of any nature, including equipment and systems of EVYA TECNOLOGIA LTDA or third parties; (v) use mechanisms other than those expressly enabled or recommended on the Site to obtain information, content and services; (vi) carry out any acts that in any way may cause any loss or damage to EVYA TECNOLOGIA LTDA or to other Users; (vii) access programming areas of the Site, databases or any other set of information that escapes the public or restricted areas of the Site; (viii) reverse engineer or allow to reverse engineer, translate, modify, alter language, compile, decompile, modify, reproduce, rent, sublease, disclose, transmit, distribute, use or otherwise dispose of the Site or the tools and functionality made available therein in any way or form, including in such a way as to violate the rights of EVYA TECNOLOGIA LTDA (including the Intellectual Property of EVYA TECNOLOGIA LTDA) and/or third parties; (ix) practice or participate in any act that constitutes a violation of any right of EVYA TECNOLOGIA LTDA (including Intellectual Property of EVYA TECNOLOGIA LTDA or third parties or any applicable law, or act in any way that may contribute to such breach; (x) interfere with security or commit undue uses against the Site or any resource of the system, network or service connected or that can be accessed through the Site, and access to the Site only for lawful and authorized purposes; (xi) use the domain of EVYA TECNOLOGIA LTDA to create links or shortcuts to be made available in unsolicited emails (spam messages) or on websites of third parties or the User himself or, even, to carry out any type of action that may harm the EVYA TECNOLOGIA LTDA or third parties; (xii) use automated data collection and selection applications to carry out mass operations or for any purposes or, even, to collect air and transfer any data that may be extracted from the Site for unauthorized or unlawful purposes, (xiii) use the Site's tools and functionalities to disseminate messages unrelated to the Site or the Site's purposes, including messages of a racist, ethnic , political, religious, cultural or derogatory, defamatory and/or libelous of any person or social group. The User agrees to indemnify, defend and hold EVYA TECNOLOGIA LTDA harmless from any claim, notification, subpoena or judicial or extrajudicial action, or from any liability, damage, cost or expense arising from any breach and/or infraction committed by the User or any person acting on your behalf, with your consent or tolerance, in relation to the Site (including in relation to any provision of these Terms and Conditions of Use), including any person who has obtained User data related to your Access Account or your navigation on the Site. EVYA TECNOLOGIA LTDA may, at its sole discretion, block, restrict, disable or prevent access by any User to the Site, in whole or in part, without any prior notice, whenever inappropriate conduct by the User is detected, without prejudice to administrative measures , extrajudicial and judicial that it deems convenient.
3. Customer Registration
In order to gain access to the complete content and to all the tools and functionalities of the Site, including the possibility of making Purchases, the User must create an Account with personal data, which will be stored and used to identify Purchases, to be used under the terms of Privacy and Security Policy, emphasizing that the creation of each Account assumes express consent to the collection, use, storage and processing of personal data by EVYA TECNOLOGIA LTDA and/or by third parties contracted by it to carry out any procedure or process related to the Purchases, including payment processing, deliveries, returns, etc. Each Customer is allowed to create only one Access Account and EVYA TECNOLOGIA LTDA reserves the right to suspend or cancel any duplicate Access Accounts. Upon completing his Access Account, the Customer declares that the information provided is complete, true, current and accurate, and it is the Customer's sole responsibility to update his Access Account data whenever there is a change in name, address or any other relevant information. EVYA TECNOLOGIA LTDA may refuse, suspend or cancel a Customer's Access Account whenever it suspects that the information provided is false, incomplete, outdated or inaccurate or even in the cases indicated in the applicable laws and regulations, in these Terms and Conditions or in any Site Policy, even if previously accepted. The Client, when creating his Access Account, will determine his username and his access password. It is the sole responsibility of the Customer to maintain the secrecy of the username and/or access password relating to their Access Account, and the Customer must immediately notify EVYA TECNOLOGIA LTDA in case of loss, disclosure or theft of the password or even unauthorized use of your Account. Minors (under 18 years of age) will not be able to use the Site, unless they are represented and/or assisted by their parents or legal guardians and authorized by them at the time of creating the Account. The creation of an Account in the name of a minor presupposes the representation of this minor by a person over 18 years of age, who will be considered civilly and criminally responsible for any Purchase made, violation committed or false, incomplete, outdated or inaccurate statement provided by the minor. 18 years.

5. Product offer
Information. EVYA TECNOLOGIA LTDA will make available on the Site, for each product, a descriptive page, which will contain information regarding its characteristics, composition, possible risks it may pose to health and safety, expiry date, origin, availability in stock, conditions of payment and full price up front.
Territory. The Site has manual (through information provided by the User) and automatic (through cookies) geolocation tools that determine the content to be presented to each user. However, due to the limitations of such tools, it is possible for the User to access content (including product offers) directed to a geographical area different from the one in which he is located. In any case, the offer of products will always be limited to the territory in which EVYA TECNOLOGIA LTDA offers delivery, under the terms of item 3 of the Product Delivery Policy, not being valid for locations not included in this territory. EVYA TECNOLOGIA LTDA may, at its sole discretion, change this territory, including or excluding locations. In case of doubt, the user may consult the Product Delivery Policy or contact CALM (EVYA TECNOLOGIA LTDA Call Center).
6. Stock
EVYA TECNOLOGIA LTDA has a large number of items registered on the Site. For reasons beyond the will and control of EVYA TECNOLOGIA LTDA, it is possible that some of these items are temporarily unavailable, due to peculiarities, seasonality or problems in the supply chain. EVYA TECNOLOGIA LTDA undertakes to engage its best efforts to maintain the availability of the greatest possible quantity of items. We also note that the Site and the physical stores of EVYA TECNOLOGIA LTDA have separate stocks, and it is possible that an item unavailable on the site is available in a physical store and vice versa. In case of Purchase of a product that is out of stock due to failure to update the Site, EVYA TECNOLOGIA LTDA will contact the Customer with a view to immediately solving the problem, refunding the amount paid, choosing an equivalent product or determining to wait the availability of the product.
7. Promotions
Realization. EVYA TECNOLOGIA LTDA may, at any time, for purely commercial reasons and at its sole discretion, create and maintain promotional campaigns, offering certain products at prices lower than those usually practiced or with the incidence of discounts.
Conditions. Promotions will not be cumulative and may be limited to: (i) a certain number of products on sale; (ii) to a certain period of time; (iii) acceptance of special conditions, such as the impossibility of exchanging the product. Territory. Promotions for Purchases on the Site will be restricted to the territory in which EVYA TECNOLOGIA LTDA provides delivery, under the terms of item 3 of the Product Delivery Policy, not being valid for locations not included in this territory.
Exchanges. In the case of exchanges (when authorized by the conditions of the promotion) or returns of products purchased on the Site for promotional values or conditions, the purchase price will be considered as the purchase price actually paid by the Customer, the amount originally charged for the product in question being discarded for this purpose. .
8. Payments
EVYA TECNOLOGIA LTDA has a specific policy to regulate the means of payment for Purchases: Payment Policy. This specific policy is an inseparable part of these Terms and Conditions of Use.
9. Price
The Site presents prices valid only for purchases completed online, with delivery in the territory in which EVYA TECNOLOGIA LTDA offers delivery, under the terms of item 3 of the Product Delivery Policy, not being valid for locations not included in this territory. In such prices, all incident taxes are already accounted for, excluding only freight costs, which will be included at the time of completion of the Purchase. EVYA TECNOLOGIA LTDA is a company with activities in several countries and on multiple platforms, physical and virtual. Thus, there may be differences in product prices between different physical stores, territories and platforms where EVYA TECNOLOGIA LTDA operates, in view of the particular situations of the location, taxation and logistics. This difference cannot be used against EVYA TECNOLOGIA LTDA to force a platform to reduce its price to match the price of another. EVYA TECNOLOGIA LTDA reserves the right to revise, improve, modify and/or update the prices charged by the Site, meeting criteria of need, convenience or market fluctuations, without the need for prior notice. All prices and conditions published on the Site are valid only for purchases made on the Site itself, not being applicable to (i) any other sites; (ii) physical stores of EVYA TECNOLOGIA LTDA; (iii) physical stores of partners of EVYA TECNOLOGIA LTDA. Likewise, prices and conditions relating to physical stores are not valid for the Site.
10. Purchase Tracking In addition to sending emails informing the most important changes in the handling and delivery of a Purchase, EVYA TECNOLOGIA LTDA makes available on the Site a tool that allows Customers to follow step by step the situation of their Purchase (made, in review, in transit, cancelled, delivered, etc.). If in doubt as to the situation presented by the tool, the Customer may contact EVYA TECNOLOGIA LTDA through the CALM service channels (EVYA TECNOLOGIA LTDA Service Center).
11. Delivery
EVYA TECNOLOGIA LTDA has a specific Policy to regulate the delivery procedures for products purchased by Customers on the Site: Product Delivery Policy. This specific policy is an inseparable part of these Terms and Conditions of Use.
12. Regrets, exchanges and returns
EVYA TECNOLOGIA LTDA has a specific policy to regulate the exchanges and returns of products purchased by Customers on the Site: Exchanges and Returns Policy. There are also provisions on the Right of Withdrawal in this policy. This specific policy is an inseparable part of these Terms and Conditions of Use.
13. Warranties
Despite EVYA TECNOLOGIA LTDA's best efforts to provide accurate, up-to-date, correct and complete information, the Site may contain technical errors, inconsistencies or typographical errors. The Site, its content, its functionalities and tools are made available by EVYA TECNOLOGIA LTDA as exposed and offered on the Internet, without any guarantee, express or implied, regarding the following items: (i) compliance, by the Site or its content, with expectations of Users; (ii) continued access to the Site or its content; (iii) suitability of the quality of the Site or its content for a particular purpose; and (iv) the correction of defects, errors or flaws in the Site or its content. EVYA TECNOLOGIA LTDA reserves the right to unilaterally modify, at any time and without prior notice, the Site as well as the configuration, presentation, design, content, functionalities, tools or any other element of the Site, including the your cancellation.
14. Responsibilities
EVYA TECNOLOGIA LTDA engages its best efforts to inform, serve and protect the User. The User is solely responsible for the use of the Site, its tools and functionalities. Under no circumstances will EVYA TECNOLOGIA LTDA or its directors, representatives, agents, employees, partners, partners or service providers be liable for any emergent, indirect, punitive or expiatory damages, lost profits or other monetary damages related to any claim, action judicial or other procedure taken in relation to the use of the Site, its content, functionalities and/or tools. 15. Links to other websites
The Site may contain links to third party sites, which are inserted solely for the User's convenience. The inclusion of such links does not imply any link, monitoring or responsibility of EVYA TECNOLOGIA LTDA on the websites, respective contents or owners. Access to the sites linked to such links is not governed by these Terms and Conditions of Use and is not protected by the Policies. EVYA TECNOLOGIA LTDA recommends that the User consult the terms and conditions of use established by each website linked to the links inserted on the Website. EVYA TECNOLOGIA LTDA will not be liable, directly or indirectly, for any damages or losses caused or related to the use of any information, content, goods or services made available on the Site or on any third-party site accessed through the links made available on the Site.
16. Internet applications or computer viruses
Due to technical difficulties, Internet applications or transmission problems, inaccurate or incomplete copies of the information contained on the Site may occur. 17. Intellectual Property Rights
Marks. The User is not authorized to use, in any form or pretext, the Marks, their partial or complete reproductions or even their imitations, regardless of the purpose of such use. The User undertakes not to contest the validity of any Brand or any other distinctive sign deposited or registered by EVYA TECNOLOGIA LTDA or by any companies related to it, in any way, in Brazil or abroad. The User undertakes to refrain from making any use of the Marks or their variations (including spelling errors or phonetic variations) as a domain name or part of a domain name or in any company name, of any type or nature, in any way or form, including through the creation of domain names or emails. All other brands, product names, or company names appearing on the site are the exclusive property of their respective owners.
Content ownership. All content on the Site - including the domain name [leroymerlin.com.br], programs, databases, files, texts, photos, layouts, headers and other elements - was created, developed or assigned to EVYA TECNOLOGIA LTDA, is owned by EVYA TECNOLOGIA LTDA or licensed to it and is protected by Brazilian laws and international treaties that deal with intellectual property rights.
Prohibition of use. The User, when accessing the Site, certifies that he will respect the existence and extent of the Intellectual Property rights of EVYA TECNOLOGIA LTDA, as well as all third-party rights that are used, in any capacity, on the Site or that may be made available in the website. Access to the Site and its regular use by the User does not confer any right or prerogative over any Intellectual Property, Trademark or other content contained therein. EVYA TECNOLOGIA LTDA does not grant any authorization related to the content of the Site for any purpose. The User assumes any and all responsibility for the misuse of any Intellectual Property or Trademarks of EVYA TECNOLOGIA LTDA or third parties, both civil and criminal. The photos and images used on the Site may not reflect their original size or current situation of the reproduced scenario, being merely illustrative.
Content submitted by the Customer. By sending any content to the Site, the Customer retains ownership of its rights over said content (texts, videos, images, audio, among others), granting EVYA TECNOLOGIA LTDA a free, irrevocable, worldwide and non-exclusive license for the reproduction, modification, translation and display, in any medium or form, including on the Site, further declaring that the Client is the owner of all rights related to said content.
18. Communications and CALM
EVYA TECNOLOGIA LTDA provides a CALM to receive all communications that the User wishes to make. CALM operates through the channels
communication listed below:
(a) In person, at any of the EVYA TECNOLOGIA LTDA physical stores, during opening hours;
(b) By telephone (047) 9 9947-5405, Monday to Friday from 8:00 am to 5:00 pm;
(c) By correspondence addressed to EVYA TECNOLOGIA LTDA, Rua Duque de Caxias, 223, Centro, Gaspar - SC, always accompanied by the consumer's contact information, so that we can complete the service. In all cases, the User will receive, through the same communication channel, an immediate confirmation of receipt of his request, which will be treated and answered within a maximum period of 5 (five) days. In addition, EVYA TECNOLOGIA LTDA provides a FAQ section (Frequently Asked Questions) on this website, as well as its policies that complement and integrate these Terms and Conditions of Use: Exchanges and Returns Policy, Product Delivery Policy, Privacy Policy and Payment Security and Policy. All communications that EVYA TECNOLOGIA LTDA wishes to make to the User must be carried out through the email registered or used by the User in any communication with EVYA TECNOLOGIA LTDA. Exceptionally, EVYA TECNOLOGIA LTDA may communicate with the User by other means of communication, such as cell phone, SMS, MMS or physical correspondence.
19. Duration
These Terms and Conditions of Use and the Policies are of indefinite duration and will remain in effect as long as the Site is active. The applicable wording is that of the update immediately prior to access or Purchase. Likewise, access to and use of the Site and the resources it offers are, in principle, for an indefinite period, at the sole discretion of EVYA TECNOLOGIA LTDA. 21. Public Registry
These Terms and Conditions of Use, as well as all Policies, are registered with the Registry of Titles and Documents of the District of Gaspar of the State of Santa Catarina. Any updates to these Terms and Conditions of Use, as well as any of the Policies, will be immediately registered with the same notary.
22. Language
All legal documentation on the Site, including these Terms and Conditions of Use, was prepared in Portuguese. EVYA TECNOLOGIA LTDA may, at its sole discretion, make translations of such documents available on the Site solely for the convenience of the User, at its sole discretion. The Portuguese version of these Terms and Conditions of Use and Policies is the only one consented by EVYA TECNOLOGIA LTDA. In case of contradiction or divergence between the Portuguese version and eventual translation into any other language, the Portuguese version will always prevail.
23. Miscellaneous
Official time. In purchases made through the Site, Brasilia time must be considered official, including summer time periods.
Partial applicability. If EVYA TECNOLOGIA LTDA is unable to enforce or comply with any clause or condition contained in these Terms and Conditions of Use or in the Policies, this fact will not constitute withdrawal, tolerance or novation of that clause or condition of these Terms or any Policy. If any clause or condition contained in these Terms and Conditions of Use or in the Policies is declared unenforceable, in whole or in part, such unenforceability will not affect the other clauses of the Terms and Conditions of Use and Policies. In this case, EVYA TECNOLOGIA LTDA will make the necessary adjustments to reflect, as closely as possible, the terms of the provision declared unenforceable.
Product characteristics and health risks: EVYA TECNOLOGIA LTDA includes information on the offer page of each product regarding its characteristics and the risks it may pose to the health and safety of consumers. Before purchasing a product, the Customer must carefully read the description of use and handling on its page, as well as the indication of age range. In case of doubt, you should contact the CALM (EVYA TECNOLOGIA LTDA Call Center).
Act of God and force majeure. Neither Party will be liable to the other when the non-compliance or untimely fulfillment of an obligation set forth in the Policies or these Terms and Conditions of Use is caused by acts of God or force majeure events, while their consequences lasted. Principle of respect for Customers and Users. EVYA TECNOLOGIA LTDA's principle of action in physical and virtual environments is respect for the User, always acting in accordance with the provisions of the Consumer Protection and Defense Code (Federal Law n. 8078/90), of the Civil Rights Framework for the Internet (Federal Law n. 12965/14) and the other norms referring to the commerce of products in an electronic environment.
24. Applicable Law and Jurisdiction
